Trademarks / Service Marks
A trademark or service mark is any visible sign of distinguishing the goods (trademark) or services (service mark) of an enterprise and shall include a stamped or marked container of goods.

Filing of Application
A duly accomplished Trademark Application containing the (a) name, address, and nationality of the applicant; (b) list of goods or services and the Nice Classification class to which they belong; (c) colors being claimed (if any); and (d) a reproduction of the mark, should be filed with the Bureau of Trademarks.
For applications with a priority claim, the application should contain the name of the country where the priority application was filed, the application number and filing date. A certified true copy of the priority application should be filed within 6 months from the filing date.
Examination
If the examiner finds absolute or relative grounds for refusal of the registration, a Registrability Report will be issued. The applicant has two (2) months from the mailing date of the Report to respond to the refusal, which period may be extended for an additional period of two (2) months upon written request and payment of the extension fee.
Notice of Allowance
If the examiner finds that the application meets the requirements for registration, a Notice of Allowance shall be issued.
Publication for Opposition Purposes
The application will be published in the IPOPHL eGazette for opposition purposes. The period to file an opposition is within thirty (30) days from the date of publication.
Notice of Issuance
If no opposition is filed within thirty (30) days from the date of publication, a Notice of Issuance shall be issued requiring payment of the issuance fee for the Certificate of Registration.
Issuance of Certificate of Registration
The Certificate of Registration shall be issued upon payment of the required fee. A Certificate of Registration shall remain in force for a period of ten (10) years from date of registration.
