Renewal shall be made with the Intellectual Bureau of WIPO by:
- Communication indicating the international registration number and the relevant designated contracting parties for which the renewal is made with payment of the renewal fees;
- Submission of Form MM11 with payment of the renewal fees; or
- On-line renewal with payment of the renewal fees.
DECLARATION OF ACTUAL USE (DAU)
To maintain the registration of a mark, the following Declarations of Actual Use are required to be filed:
- 3rd Year DAU: within three (3) years from the filing date of the application (for directly-filed Philippine applications) /from the date of international registration or subsequent designation (for International Registrations)
- 5th Year DAU: within one (1) year from the fifth anniversary of the registration of the mark (for directly-filed Philippine applications)/of the date of grant of protection (for International Registrations)
- Renewal DAU: within one (1) year from the renewal date
- Mid-renewal DAU: within one (1) year from the fifth anniversary of the renewal
A one-time extension of six months can be requested to file for the 3rd Year DAU upon payment of the required fees. Requests for extension are not allowed for other DAU filings.
DECLARATION OF NON-USE (DNU)
A registrant may file a Declaration of Non-Use, in lieu of a Declaration of Actual Use, under the following circumstances:
- the registrant is prevented from using the mark due to a requirement imposed by another government agency;
- an existing restraining order or injunction issued by a court, the IPO or other quasi-judicial bodies prevents the use; or
- the mark is the subject of an opposition or cancellation case.
